If your incorporated society did not reregister by the 5th April and was removed from the register as a result, you can still apply to be restored. That means your now society has:
- No legal status
- No ability to enter contracts as the society
- No limited liability protection for members
So, you can’t “just keep operating” as an incorporated society while waiting to be restored. You either operate informally (with risk), or pause until restoration is approved, or have to close up shop.
If your society has been removed, you can apply to restore it to the register. The Registrar may restore it if it was operating at the time, and there’s a valid reason for it to continue. But restoration is not automatic and you will need to:
- Update your constitution
- Meet 2022 Act requirements
- Fill in an application
- File missing documents
- Pay a fee
